Brand Substitution occurs in a many ways. The retailer or server can refill a branded bottle with a different liquid not represented by the label. When a mixed drink is served from a bar, the server could use a different brand liquor in making the mixed drink other than that which was requested or advertised. A citation for Brand Substitution is a violation of State Alcohol Control Laws.

The citation for Brand Substitution issued to Little Woodrow’s Stone Oak, 606 W Afton Oaks Blvd San Antonio, TX 78232 by the Texas Alcoholic Beverage Commission was resolved with a written warning. A written warning does not mitigate the seriousness of the offense. A Written Warning is usually issued in response to a citation when the establishment has not had any other infractions against their liquor license. The Alcoholic Beverage Commission issuing a written warning to resolve a case of Brand Substitution believes that the citation and warning are enough to prevent future occurrences of Brand Substitution.

It is also a truth in advertising issue, when a specific brand of liquor is ordered, that is the Brand that the customer expects to receive, any substitution should only be made after the customer is informed that the Brand requested or advertised is not available at the time.
