Racks Bar and Grill, 802 W Seventh Evart , MI 49631 cited for Refilling, Misbranded or Adulterated alcoholic beverages on March 12, 2015 by the Michigan Liquor Control Commission. The violations cited Refilling, Misbranded or Adulterated alcoholic beverages all fall into the same category. Liquor bottles are numbered and sealed. A liquor retailer by law both implied and written should open a liquor bottle, serve the contents from that bottle and properly dispose of that bottle when empty. Refilling a liquor bottle with like or different contents falls under the violation of Refilling, Misbranded or Adulterated alcoholic beverages. This is a violation of State and Federal Liquor Laws as well as a violation of consumer trust. A consumer expects and has a right to receive the liquor as stated on the bottle.

For the violation of Refilling, Misbranded or Adulterated alcoholic beverages as cited by the Michigan Liquor Control Commission, Racks Bar and Grill, 802 W Seventh Evart , MI 49631 paid a fine of $300. It is incumbent of liquor retailers to serve the liquor as represented on the bottle as a best practice of commerce at a fair price, for the health of consumers and to comply with the terms of their Liquor License. When a bottle is refilled with a less expensive liquor the consumer is paying a premium price for a less than premium liquor. If a liquor in a labelled cannot be verified because it is not the liquor represented by the brand and serial number on the liquor bottle, any recall of that liquor for health reasons is not possible. When the liquor in a bottle is Adulterated, the basic tenants of trust in the seller are lost. The Consumer can no longer trust what they are being served.
